ARC Dispatch Terms of Service

Thank you for using ARC Dispatch. The platform is a community-operated website for ARC Raiders players and community photography events. These Terms of Service ("Terms") form a legally binding agreement between you and ARC Dispatch for access to and use of the service.

By registering an account, uploading a submission, or using the service, you agree to these Terms, the Privacy Policy, and any published event rules.

1. Service Description

ARC Dispatch provides an online platform where registered users may upload ARC Raiders screenshots or photography submissions, view public galleries, comment, vote or participate in judging when enabled, and browse related community content.

ARC Dispatch is not affiliated with Embark Studios, Nexon, or Tencent. The platform is an unofficial community project.

2. Eligibility and Account Registration

You must be at least 13 years old. If you are in the European Union or European Economic Area, you must be at least 16 or have guardian consent. You must also satisfy the minimum age requirements that apply to ARC Raiders in your region.

Core features require an account through Shuakami Auth. You agree to provide accurate and current information and are responsible for activity under your account. Authentication is handled by Shuakami Auth, and your use of authentication is also governed by its own terms and privacy policy.

3. User Content and Intellectual Property

You retain your rights in screenshots, photographs, captions, and other content you upload. You grant ARC Dispatch a non-exclusive, worldwide, royalty-free license to display your submissions during and after events, use them for event-related promotion, publish them in community summaries or collections, and attribute them to your username or credit line where reasonably practical.

All ARC Raiders game content, marks, logos, characters, items, images, and related materials belong to their respective rights holders. Our use of game content is limited to community display, commentary, information sharing, and fair-use style purposes.

You represent that you created the submitted work or have the required permission to submit it, and that your content does not infringe third-party rights.

3.1 Open Uploads and Rights Protection Mode

When uploading a work, you may choose open upload or enable rights protection mode. Open upload means you allow the work to be displayed, copied, shared, and downloaded as an ordinary public submission after review, and the platform handles it through the normal image ID and content review flow. Rights protection mode means you ask the platform to add an invisible provenance marker before public display and to generate the final image ID from the processed public image; before processing completes, the platform will not display or promise a final image ID.

Rights protection mode is intended to improve provenance checks for ordinary resharing, compression, screenshots, or reposting. It is not copyright registration, legal proof of ownership, encryption, access control, or an unremovable security mechanism. You understand that targeted editing, regeneration, cropping, filters, or other adversarial processing may damage or remove a watermark. The platform may use watermark records, image IDs, hashes, and audit records to assist complaints, DMCA requests, reposting disputes, authorship disputes, or abuse investigations, but we do not guarantee that any dispute can be resolved by watermark evidence.

3.2 Download Frames and Redistribution

The platform may generate a downloaded version with a visible frame, brand mark, author mark, or event mark when a user clicks a download button. That downloaded version is a derivative file for sharing and attribution display. It does not change ownership and is not used as the platform image ID or hash-tracking basis. You may not remove, obscure, or misleadingly alter frames, credits, provenance marks, or other attribution information to impersonate an author, mislead others, or avoid these Terms.

The platform does not promise to fully prevent others from copying public images through browser cache, developer tools, screenshots, third-party caches, search engines, or other methods. If you choose open upload, you understand that public works may be copied, saved, or shared by others. If you choose rights protection mode, the platform will process the public image using the current technical method and reasonably assist later complaints, but copyright claims, licensing disputes, DMCA requests, and other legal enforcement remain primarily the responsibility of the rights holder.

4. Prohibited Conduct

You may not use the service for illegal, fraudulent, infringing, abusive, harassing, spam, or unauthorized purposes. You may not attack or disrupt the service, bypass security or authentication, steal or repost another creator's work, manipulate voting, distribute malware, impersonate official staff, collect other users' personal information without authorization, or upload illegal or severely harmful content.

5. Community Reports and Report Abuse

To protect the community, you may use in-product reporting tools or contact email to report content that you reasonably believe violates these Terms, event rules, copyright rules, privacy rights, harassment rules, spam restrictions, abuse standards, or other public-display requirements. Reports should be submitted responsibly, based on a genuine and reasonable good-faith belief, and should include accurate reasons and necessary context where practical.

You may not abuse reporting tools, including by submitting malicious reports, repeatedly filing unsupported reports, using reports to harass others, attempting to suppress legitimate comments or submissions through reports, submitting false information, or impersonating a rights holder. We may ignore, merge, or close reports that are clearly unsupported, duplicative, or abusive. For serious or repeated report abuse, we may restrict reporting access, limit an account, suspend or terminate an account, and reserve the right to pursue accountability.

After receiving a report, we may review the content, context, history, platform rules, and applicable law, and may take actions including no action, hiding content, removing content, limiting display, locking interactions, issuing warnings, suspending accounts, banning accounts, or retaining audit records. Report outcomes are based on information available to the platform, and not every report will result in content removal or account action.

6. Copyright and DMCA

ARC Dispatch follows DMCA and applicable intellectual property law. If you believe content on the service infringes your rights, email sal_scoria@vaiiya.org with enough information to identify the work, locate the allegedly infringing material, contact you, and confirm your good-faith belief, accuracy, and authority to act. After receiving a valid notice, we may remove or disable access to the content and notify the uploader where appropriate.

If a user believes content was removed by mistake, they may submit a counter-notice to the same email address. A valid counter-notice should include a signature, identification of the removed content, a good-faith mistake statement, contact details, and consent to the relevant jurisdiction.

7. Unofficial Status and Availability

ARC Dispatch is a community project and is not an official website of Embark Studios, Nexon, or Tencent. We do not guarantee that the service will remain available permanently. The service may change, pause, or shut down for technical, legal, community, or rights-holder reasons.

8. Privacy and Data Protection

Your use of the service is governed by our Privacy Policy, which explains how we collect, use, protect, export, and delete personal information.

9. Termination and Suspension

You may stop using the service or delete your account through account settings. We may suspend, restrict, or terminate your account or content display if you violate these Terms, event rules, copyright rules, or security requirements. Serious or repeated infringement may result in a permanent ban.

After termination, your right to use the service ends immediately. Data deletion, retention, and audit records are handled according to the Privacy Policy and applicable legal obligations.

10. Disclaimer

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free service.

11. Limitation of Liability

To the fullest extent permitted by law, ARC Dispatch and its operators, employees, or agents are not liable for indirect, incidental, special, punitive, or consequential damages. If liability cannot be excluded, our total liability is limited to the amount you paid to the service in the previous 12 months; if you paid nothing, the limit is USD 100.

12. Indemnification

You agree to indemnify and hold ARC Dispatch, its operators, employees, and agents harmless from claims, losses, liabilities, costs, and expenses arising from your violation of these Terms, your content, your violation of law, or your use of the service.

13. Third-Party Services

The service may link to or depend on third-party services such as Shuakami Auth and Vercel. Those services are governed by their own terms and policies. We are not responsible for their content or privacy practices.

14. Changes to These Terms

We may revise these Terms from time to time. Material changes will be announced on the website or by email. Continued use of the service after changes means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, while preserving any mandatory consumer rights that apply in your jurisdiction. The parties should first attempt to resolve disputes informally. If that fails, disputes may be brought before a court with proper jurisdiction.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and published event rules, form the entire agreement between you and ARC Dispatch regarding use of the service.
